The following Promotion shall be governed by Michigan law, without regard to conflict of law provisions. Each entrant is referred to herein as “you” or “your” in these Official Rules. Do not enter this Promotion if you do not meet the following requirements at the time of entry.

Eligibility:

The “Amazon Prime Day” promotion (the Promotion) is open only to legal residents of the United States, who, at the time of entering the Promotion are eighteen years of age or older and are existing FinancialEdge Credit Union accountholders in good standing. All entrants must be natural persons. No entries from business entities accepted. Employees and officials of FinancialEdge Credit Union, their immediate families (parent, child, sibling or spouse) and/or persons living in their households, and any other persons or entities associated with this promotion are ineligible to enter or win. Void where prohibited by law.

Sponsor/Administrator:

The Promotion is sponsored and administered by FinancialEdge Credit Union (“FinEdge”), 1199 S Euclid Ave, Bay City, MI 48706.

Agreement to official rules:

By participating, you agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Promotion. Winning the Grand Prizes (as defined below) is contingent upon fulfilling all requirements set forth herein.

Promotion Period.

The Promotion begins on July 15, 2019 at 12:00 am Eastern Standard Time (EST) and ends on July 16, 2019 at 11:59 pm EST (the “Promotion Period”).

How to Enter:

No Purchase Necessary to Enter or Win. There are Two Methods of Entry: During the Promotion period, you may enter by:

Automatic Entry: You will automatically receive one Promotion entry for every purchase* on Amazon.com you make with your FinancialEdge Credit Union Mastercard Debit and Credit Card during the Promotion Period. All automatic Promotion entries will be submitted in the name of the primary account holder.

No Purchase Necessary Entry: You will receive one Promotion entry when you complete a 3x5 index card with your complete name, age, address, phone number and email address to Marketing - FinancialEdge Credit Union, PO Box 446, Bay City, MI 48707-0446. Maximum of one 3x5 card entry per person. Entries must be received before 11:59 p.m. on July 16, 2019.

General conditions:

If for any reason the operation or administration of this Promotion is impaired or incapable of running as planned for any reason, including but not limited to (a) infection by computer virus, bugs, (b) tampering, unauthorized intervention, (c) fraud, (d) technical failures, or (e) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion, to disqualify any person who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion in whole or in part, at any time, without notice and award the applicable prize using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. Sponsor reserves the right, at its sole discretion, to disqualify any person deemed to be (a) tampering or attempting to tamper with the entry process (b) acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

Release and limitations of liability:

By entering the Promotion, each person agrees to release and hold harmless the Sponsor, their respective employees, officers, directors, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) any errors that may prevent a person from submitting an entry; (b) unauthorized human intervention in the Promotion; (c) printing errors; (d) errors in the administration of the Promotion or the processing of entries; (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the Promotion or receipt of any prize; or (f) all claims based on publicity rights, defamation, use of image or likeness and/or breach of any right of privacy. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Promotion or downloading any materials in this Promotion. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney’s fees. Each person entering the Promotion waives the right to claim any damages whatsoever, including, but not limited to, punitive, exemplary, incidental, consequential damages, whether direct, or indirect.

Drawing and notification:

The winners will be selected by a random drawing from all eligible entries received by the Administrator whose decisions are final and binding. Grand Prize drawing will be conducted on or about July 25, 2019. The winners will be notified no later than July 29, 2019 via telephone and/or email. If one or both winners do not respond by August 12, 2019, another winner will be drawn. Odds of winning will depend on the total number of eligible entries received throughout the Promotion Period.

Grand prize:

There will be two (2) Grand Prizes awarded. The two (2) available prizes are as follows:

• Amazon Gift Card ($100)
• Amazon Gift Card ($100)

Prize conditions:

The potential Grand Prize Winner agrees to sign a public publicity release for FinEdge to use your name and likeness for editorial, advertising and publicity purposes without additional compensation, except where prohibited by law. The winner may, at FinEdge’s discretion, be required to sign and return a declaration of eligibility, additional release of liability, and, where lawful, an additional publicity consent agreement. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to return the completed and executed declaration and releases as required, the prize will be forfeited and awarded to an alternate winner. The Grand Prize Winners will be responsible for all local, state, and federal taxes associated with the receipt of a prize. The Grand Prize Winners must note that the value of their accepted Prize is taxable as and the Winner is solely responsible for all matters relating to the prize after it is awarded. The Sponsor reserve the right in its sole discretion to substitute any prize package with another prize of equal or greater value in the event that the prize (or any component thereof) is not available as determined by the Sponsor in its sole discretion.

General:

By accepting the Grand Prize, where permitted by law, the Grand Prize Winners grants to the Released Parties and those acting pursuant to the authority of Sponsor and the Released Parties (which grant will be confirmed in writing upon Sponsor’s request), the right to print, publish, broadcast and use in all media without limitation at any time the Prize Winner's full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification.

Use of data:

All information submitted will be treated according to Sponsor's privacy policy, available at www.finedgecu.org/privacy. By participating in the Promotion and providing your contact information, all persons entering hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have agreed to be bound by Sponsor’s Privacy Policy.
